Information obligation

In accordance with Article 13 of the Regulation of the European Parliament and of the Council of the EU of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC on the processing of personal data (i.e. OJ EU. L. 2016.119.1), hereinafter: the "RODO", and on the protection of privacy (hereinafter: the "Notice").    

Fast Forward Solutions Sp. z o.o. with its registered office in Gdańsk, 80-309 Grunwaldzka 472 is the Administrator of Personal Data (hereinafter referred to as "Administrator").

The Administrator will process your Personal Data in order to properly provide services within the scope of the form you have filled in and to provide commercial and marketing information.

The Administrator is committed to protecting your Personal Data and privacy.

Through the Site, you may search for and apply to positions offered by the Company that are consistent with your interests, skills or experience and that are available in the location where you are seeking employment.

The use of www.ffsolutions.pl and www.ffsolutions.iois tantamount to acceptance of the provisions contained herein.

The following information is provided in connection with the obligation imposed on the Administrator by Article 13 of the RODO.

  1. What kind of Personal Data is collected and processed by the Administrator?

The personal data collected by the Administrator includes:1) your name, date of birth, contact details, education, previous work history; 2) if you contact us, in some cases we may retain a record of such correspondence; 3) in some cases, your web browser preferences, IP address, traffic and frequency of visits to the Fast Forward Solutions website, and location data and resources used.

The data collected is used to provide the best possible service and for administrative, statistical and advertising purposes, to protect the website and its users, and to provide commercial and marketing information.

Personal data will be processed until there is a basis for processing i.e:

1) where consent has been given until it is withdrawn, restricted or there is any other action on your part restricting that consent,

2) in the event that the data is necessary for the performance of a contract, for the duration of its performance and until the expiry of the limitation period for claims arising from this contract,

3) where the processing is based on the legitimate interest of the controller, until you make an effective objection,

4) for tax and accounting purposes to the extent and for the duration required by applicable law.

Rights relating to the processing of personal data:

  • the right of access to data, including the right to obtain a copy of data,
  • the right to request rectification of data,
  • the right to erasure (right to be forgotten),
  • the right to lodge a complaint to the supervisory authority for the protection of personal data, which in Poland is the President of the Office for Personal Data Protection,
  • the right to restrict data processing.
  • the right to object (objection to processing, objection to direct marketing, including profiling, legitimate objection to the processing of your data in the legitimate interest of the Controller),
  • the right to withdraw consent. Withdrawal of consent does not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal. If your data is processed on the basis of consent or for the performance of a contract.
  1. Why do we process your personal data?
  • In connection with the implementation of the recruitment process, in accordance with Article 22¹ §1 of the Act of 26.06.1974 Labour Code (i.e. Journal of Laws of 2018, item 108, as amended), hereinafter referred to as the "Labour Code", in connection with Article 6(1)(c) of the RODO as part of the implementation of the legal obligation incumbent on the controller of personal data. Providing data is voluntary and necessary to participate in the recruitment process.
  • For marketing purposes, in particular: sending information about new products and services and offers, additionally informing about new forms of contact with the administrator. Providing the data is voluntary and the consent will be granted on the basis of Article 6(1)(a) of RODO.
  • In the case of uploading a document with a photo (CV) or uploading a photo on the application form, the processing of the image takes place on the basis of the consent indicated in Article 22² § 1 of the Labour Code in connection with Article 6(1)(a) of the RODO, the consent is voluntary and necessary in the case of uploading a photo via the application form.
  • Due to the necessity of profiling - compiling information about you in an automated manner and automatically adjusting your profile for job offers in order to provide services based on the latest technological solutions, in accordance with Article 6(1)(a), in conjunction with Article 22(1) and (4) of the RODO.
  • Due to the need to develop, test and improve the website domain and other existing or new IT systems/processes to provide an even better service.
  1. On what basis do we process your personal data?

The processing of personal data takes place on the basis of your consent in each case, in accordance with the RODO and UODO. You decide to consent to the entrustment of personal data, this is not necessary, but is necessary in connection with the provision of services to you, without your consent we will not be able to provide the services you are interested in.

The rights of Fast Forward Solutions Sp. z o. o. with its registered office in Gdańsk, 80-309 Gdańsk, at Aleja Grunwaldzka No. 472, are exercised in accordance with the RODO and the Act of 10 May 2018 on personal data protection (i.e. Journal of Laws of 2018, item 1000, as amended), hereinafter referred to as the "RODO", in relation to the data entrusted by you as a Service User on the basis of the consent granted in the form of a declaration (legal basis indicated, inter alia, in point 2 above).

For necessary and appropriate purposes justified by law, the Administrator shall be entitled to entrust personal data to state administrative bodies only in cases where the entrustment of data results from a legal obligation to which the Administrator is subject or is necessary for the performance of a task carried out in the public interest or in the exercise of public authority.

Where processing is necessary within the framework of the legitimate interests of the Controller, we shall ensure that your interests and fundamental rights and freedoms shall prevail.

Only with your consent will we process personal data whose legal grounds for processing are not indicated in this Notice (additional legal grounds for processing).

  1. How long do we keep your personal data? 

The controller may keep your personal data for a maximum of 2 (two) years after you have registered via the website.In the event that you are employed through this website, your personal data will be stored for a longer period in order to comply with the law.

  1. Do we share data with other recipients?

The recipients will be contractually obliged to maintain the confidentiality of your personal data and respect your privacy. They will only have access to data which is necessary for them to carry out their duties and services.

In the case of other entities, the entrustment and processing of personal data shall only take place due to a legitimate need of the controller, in accordance with applicable Polish law, in particular:

  • for the performance of services for Fast Forward Solutions Sp. z o. o. and its subsidiaries, including but not limited to the performance of administrative and operational work in order to improve and support the services provided; provision and improvement of hosting and support of IT systems; provision of services related to financial consultancy and management;
  • to cooperating entities or field offices of Fast Forward Solutions Sp. z o. o. and its subsidiaries, located within or outside the European Union, in cases necessary and appropriate in connection with the provision of services to you;
  • clients of Fast Forward Solutions Sp. z o. o. and its subsidiaries, responsible for the recruitment process or offering jobs or projects that may be of interest to you or who are interested in your application for a given position;
  • Clients/potential employers are obliged to observe contractual and other confidentiality obligations in relation to the data provided;
  • to governmental authorities, state supervision, law enforcement agencies, including the police, if we, as Administrators, are obliged to make them available.

 

  1. Do we process personal data by automated means?

Yes, however it is not every behaviour and processing. We use automated systems/processes and automated decision-making (e.g. profiling), for the sake of best service delivery.

Among other things, we perform automated searches for lists of candidates and job applicants, input automated criteria that take into account availability, skills, rates and in some cases feedback provided to us by clients to produce a shortlist that contains a ranked list of candidates who most closely meet client requirements.

  1. Do we transfer your personal data outside the European Union?

As a rule, the Administrator does not transfer or process your personal data outside the borders of the European Union, including outside Poland.

The statement indicated in the sentence above will change when an offer is made in connection with the recruitment of positions for foreign clients. In this case, personal data may be entrusted to the client named in the offer or to a foreign entity/branch subordinate to the specified entity. In this case, the data may be transferred to and processed in one or more countries within or outside the European Union.

When personal data is transferred to countries outside the European Union, these will be countries which, in the opinion of the European Commission, provide an adequate level of data protection or where Fast Forward Solutions Sp. z o. o. or its subsidiary has implemented appropriate safeguards to ensure the protection of personal data and privacy.

  1. The rights of an individual, i.e. the Candidate, who is a User of the Service.
  • the right to access your personal data and to receive a copy of that data;
  • The right to request confirmation as to whether we are processing any of your personal data;
  • The right to amend your personal data and the right to update or correct that data;
  • The right to erasure of personal data (the so-called right to be forgotten);
  • The right to restrict personal data (in certain cases).

You should then make a request to the Administrator, who will assess whether it is justified. If the request is lawful, the Administrator will delete the data without undue delay. Please note that in this case the provision of services will cease;

  • the right to object to the President of the Office for Personal Data Protection, which is the supervisory authority.

Objections can be made to the processing of personal data and direct marketing, including profiling, on each legitimate basis;

  • The right to withdraw consent. The withdrawal of consent shall not affect the lawfulness of the processing carried out on the basis of consent before its withdrawal if your personal data are processed on the basis of consent or for the performance of a contract.
